Ritter Sport’s colorful square packaging has long distinguished the German brand’s chocolates at duty-free shops and on store displays. Now, based on a ruling by Germany’s Federal Court of Justice, no other top-tier chocolatiers can sell similarly shaped products. This judgment goes against rival Milka, which challenged Ritter Sport’s 1993 patent and trademark in a lower court in 2016—and initially won. According to BBC, the recent ruling took into account the public’s perception of the 88-year-old brand and the square shape’s association with quality. To celebrate this critical win, perhaps Ritter Sport should consider “Sweet Revenge” as one of its new seasonal flavors.
